Wayne went on to explain the circumstances of his arrest from his point of view. My best guess was that he was absolutely telling the truth. I had to warn him though that the ‘planted evidence’ defence very rarely convinces a jury. I instructed him to give a ‘no comment’ interview and promised him I would do my best to persuade the officer in charge to grant him bail. He still seemed remarkably relaxed about the whole thing and his interview was a peach. One part will live on in my memory:

DC BAILEY

Why were you in the car with your father?

WAYNE

No comment other than that I prefer having a lift to walking.

DC BAILEY

Why are you willing to give me that information but have replied ‘no comment’ to most of my other questions?

WAYNE

No comment other than that my hatred of walking is a question of lifestyle and character and I never want to be misinterpreted on those matters.

DC BAILEY

Is taking drugs part of your lifestyle and character?

WAYNE

No comment other than to say I have never taken any illegal drugs, as my lifestyle and character are inconsistent with that activity.

DC BAILEY

Where were you driving to when the police stopped you?

WAYNE

No comment other than that we were going to the supermarket to buy some cat litter.

ME

Wayne, can I remind you that I have advised you to reply ‘no comment’ to all questions.

WAYNE

DC BAILEY

Why did it need two of you to buy cat litter?

WAYNE

No comment other than to say that it’s quicker to drop one person off at the door and park by the cash machine than go alone and have to find a place to park. Also my dad thinks it’s a bit feminine to purchase cat litter.

DC BAILEY

Did you know there was a bag of class-A drugs under your seat?

WAYNE

No comment other than to say there is still a cat at home that is desperate for a shit.

Once the interview was over, Wayne was taken back to his cell. I had a chat with DC Bailey, who indicated that the custody sergeant was happy to release Wayne on bail pending further investigation. I got the faint feeling that Bailey believed that Wayne knew nothing about the drugs. His father was not going to be granted police bail so obviously they thought he did have something to do with the drugs.
