(i) Repeal/substantial amendment in the Illegal Migrants (Determination by Tribunals) Act, 1983 in view of the impediments in detection and deportation of illegal migrants under the provisions of the said Act as pointed out aforesaid;
(ii) Reduce the distance between two BSF posts on the borders from 6-8 Kms to 2-3 Kms;
(iii) Creation of dedicated BSF exclusively for Assam and involving the local youth in the said Force;
(iv) Watch the borders with high-tech facilities like satellite surveillance, improving communication facilities, ensuring mobility on the roads as well as on rivers;
(v) Coordination with Bangladesh Government to accept the illegal migrants once they are determined as foreigners/illegal migrants by the Courts/Tribunals of our country;
(vi) Proposal of multi-purpose photo identity cards should be implemented forthwith particularly in the border villages. This work should be done in a time frame. Issue of Photo Identity Cards to the genuine Indian Citizen will go a long way in checking the illegal migration. The Election Commission of India’s move to issue Photo Identity Cards to the Indian voters appears to be a step in right direction for checking the illegal migration from the neighbouring countries.
While issuing the Photo Identity Cards as above, a suitable process will have to be evolved to ensure that no illegal migrant retain his name in the Voters List and the names of such illegal migrants are completely deleted from the Voters List immediately after detection.
Photo Identity Cards as and when issued could also be used for grant of work permits to by duly authenticated by competent authority for engagement in non-governmental job, like contractors, labour, vendors, menials etc.
22. It is pertinent to mention here that in the recent past there appears to be a close nexus between the illegal Migrants and the Fundamentalist organization on the one hand and between the Fundamentalist organizations and Pak ISI (Pakistan Inter-Services Intelligence) on the other. The Pakistan ISI has increased their nefarious activities in India whose action plan interalia includes subverting the Border Areas by utilizing the Fundamentalist Organizations in carrying out Anti India activities. The recent arrests of 4 (four) Pakistani Inter-Services Intelligence (ISI) Agents at Guwahati, Assam, has amply proved the sinister activities of the ISI and its well-laid plans in league with Muslim Fundamentalist Organization as well as ULFA and other Militants Outfits for destabilization of the State by indulging in large-scale subversive activities which is a cause of serious concern for the safety, security and integrity of the Nation.
The state of Assam assures this Hon’ble Court that it is taking the issue of detection and deportation of illegal migrants and prevention of further illegal migrants into Assam with all seriousness and sincerity.
